When you visit our Site, open or click on emails we send you, or interact with our Services or advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.

We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account.
Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Site and other websites.
Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.

Your Rights

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response to the request. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

Malaysia — Personal Data Protection Act 2010 (PDPA)

If you are located in Malaysia, this Privacy Policy is also intended to satisfy our obligations as a "data user" under the Personal Data Protection Act 2010 ("PDPA"). Logan Marks Sdn Bhd is the data user responsible for the personal data described in this Privacy Policy, which we process for the purposes set out above — including fulfilling your orders, operating your Newros wallet and Newrocode, verifying your identity, and communicating with you about your account and orders, and, where you are a Partner, Vendor, Community Affiliate, or Professional Affiliate, administering your onboarding, payouts, and agreements with us.

In line with the PDPA's General, Notice and Choice, Disclosure, Security, Retention, Data Integrity, and Access Principles, we:

only collect personal data that is necessary for, or directly related to, the purposes described in this Privacy Policy;
do not disclose your personal data to third parties other than as described in the "How We Disclose Personal Information" section above, or as required or permitted by Malaysian law;
take reasonable technical and organizational steps to protect your personal data from loss, misuse, and unauthorized access;
keep your personal data only for as long as necessary to fulfil the purposes it was collected for, or as required by law; and
take reasonable steps to keep your personal data accurate, complete, and up to date.

Under the PDPA, you have the right to:

Request access to the personal data we hold about you;
Request correction of any personal data that is inaccurate, incomplete, or outdated;
Withdraw your consent to our processing of your personal data, in whole or in part (though this may limit or prevent your continued use of some or all of our Services);
Object to processing of your personal data that is likely to cause you damage or distress; and
Limit the processing of your personal data for direct marketing purposes, by using the unsubscribe option in our marketing communications or by contacting us directly.

Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. If you are not satisfied with our response to your complaint, depending on where you live you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority.

International Users

Please note that we may transfer, store and process your personal information outside the country you live in. Your personal information is also processed by staff and third party service providers and partners in these countries.

If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

Google API Services User Data

Brainstore.asia's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements.

We use the following Google services, only for the specific purposes below:

Google Calendar API. When a Professional Affiliate (practitioner) connects their own Google account, we create a calendar event with an auto-generated Google Meet link on their calendar when a customer books and pays for a session with them, and we update or cancel that same event if the session is later rescheduled or cancelled, so the practitioner can host the video call. We never access, read, or modify any other event on that calendar.

Data obtained through these APIs is used solely to provide the features described above. It is never used for advertising, never sold or shared with third parties other than Google itself as the service provider, and is never read by humans except as strictly necessary for customer support or to maintain the security and proper functioning of these features.

Terms of Service

These Terms of Service ("Terms") govern your access to and use of brainstore.asia and any related services, content, and features (collectively, the "Services"), operated by Logan Marks Sdn Bhd ("Brainstore.asia", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. About Brainstore.asia

Brainstore.asia is a Malaysia-based marketplace for brain health, mental wellness, and wellbeing products and services. Some items and services available through the Services are sold and fulfilled directly by us, while others are listed and fulfilled by independent Partners, Vendors, and Professional Affiliates who have been onboarded onto our platform (see Section 7 below).

2. Eligibility & Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or place an order on the Services. If you are creating an account on behalf of a minor for wellbeing tracking purposes, you represent that you are their parent or legal guardian and consent to this Privacy Policy on their behalf.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at the contact details below if you suspect any unauthorized use of your account.

3. Products & Services Offered

Through the Services you may purchase physical products (such as supplements and devices), and book digital and in-person services such as courses, workshops, events, coaching, and consultations with independent practitioners. Product descriptions, availability, and pricing are subject to change without notice.

4. Orders, Pricing & Payment

All prices are listed in Malaysian Ringgit (MYR) unless stated otherwise. Payments are processed through our third-party payment gateway, Billplz. By placing an order, you authorize us and our payment processor to charge your chosen payment method for the total order amount, including applicable shipping and taxes.

We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or unavailability of stock. If your order is cancelled after payment has been made, we will issue a full refund to your original payment method.

5. Newros Points, Rewards & Newrocodes

Members may earn "Newros" loyalty points on qualifying purchases and redeem them for eligible products, services, and offers on the Services. Newros points have no cash value, cannot be transferred, sold, or exchanged for cash, and may be forfeited if your account is closed or found to be in violation of these Terms. Newrocodes (promotional or partner discount codes) are subject to their own stated terms, validity periods, and eligibility criteria, which may be amended or revoked at our discretion.

6. Partners, Vendors, Affiliates & Fulfillment Partners

Certain products, brands, and services on the Services are offered by independent Partners, Vendors, Community Affiliates, and Professional Affiliates ("Third-Party Providers"). Third-Party Providers are independent contractors and are not employees, agents, or representatives of Brainstore.asia. While we vet Third-Party Providers before onboarding them, we do not control and are not responsible for the quality, safety, legality, or accuracy of the products or services they list, nor for their fulfillment of orders. Any dispute regarding a Third-Party Provider's product or service should first be raised with us so we can help facilitate a resolution, but the ultimate responsibility for that product or service rests with the Third-Party Provider.

7. No Medical Advice

Brainstore.asia does not provide medical, psychological, or healthcare advice. All content on the Services, including product descriptions, articles, and practitioner-led sessions, is for educational and informational purposes only and does not replace professional medical diagnosis or treatment. Always consult a qualified healthcare provider before starting any supplement, therapy, or wellness program, particularly if you have an existing medical or mental health condition.

8. User Conduct

You agree not to misuse the Services, including by: submitting false or misleading information; attempting to gain unauthorized access to any account, system, or network connected to the Services; using the Services for any unlawful purpose; or interfering with another user's enjoyment of the Services. We reserve the right to suspend or terminate accounts that violate this section.

9. Intellectual Property

All content on the Services, including text, graphics, logos, and software, is owned by or licensed to Brainstore.asia and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Services without our prior written consent.

10. Third-Party Links & Services

The Services may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party websites or services.

11. Disclaimers & Limitation of Liability

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, Brainstore.asia and Logan Marks Sdn Bhd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, or from any product or service provided by a Third-Party Provider. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the specific order giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Brainstore.asia, Logan Marks Sdn Bhd, and our officers, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Services.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, Third-Party Providers, or us.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Malaysia, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

Shipping Policy

1. Order Processing Time

Orders are typically processed and handed to our courier partners within 1–3 business days of payment confirmation. Orders placed on weekends or public holidays will begin processing on the next business day. Processing times may be longer during promotional periods or for made-to-order and pre-order items, which will be noted on the relevant product page.

2. Shipping Coverage & Couriers

We currently ship to addresses within Malaysia. Orders are delivered through our network of trusted courier partners, with the courier automatically selected to give you the best combination of speed and reliability for your delivery address. Estimated delivery times are typically 2–7 business days from dispatch, depending on your location within Malaysia.

3. Shipping Fees

Shipping fees, if any, are calculated at checkout based on your delivery address, order weight, and any active promotions (such as free-shipping thresholds). Any applicable shipping fee will always be shown to you before you complete payment.

4. Order Tracking

Once your order has been dispatched, you will receive a shipping confirmation with tracking information. Members can also view live shipment status and full delivery timelines at any time from their Order History in Arcadia, our member portal.

5. Orders Fulfilled by Partners

Some products on Brainstore.asia are sold by independent Partners and may be picked up and shipped directly by that Partner or their nominated Fulfillment Partner rather than from a central Brainstore.asia warehouse. In these cases, delivery timelines may vary slightly from the estimates above, but tracking will still be made available to you through the same Order History view.

6. Delivery Issues, Delays & Lost Packages

While we work with reliable courier partners, delays can occasionally occur due to weather, high demand periods, or courier network disruptions outside our control. If your order has not arrived within the estimated delivery window, please contact us at the details below and we will investigate with the relevant courier or Partner on your behalf.

7. Address Accuracy

Please ensure your shipping address, contact number, and email are accurate and complete at checkout. We are not responsible for delays, additional charges, or non-delivery resulting from an incorrect or incomplete address provided by you. If a package is returned to us due to an incorrect address, we will contact you to arrange redelivery, which may incur an additional shipping charge.

8. International Shipping

We do not currently offer shipping outside Malaysia. If this changes, this Shipping Policy will be updated accordingly.

Refund Policy

1. Returns Eligibility

You may request a return within 7 days of receiving a physical product, provided the item is unused, unopened, and in its original packaging with all seals intact. Because of the health and safety nature of many of our products, items that have been opened, used, or where the seal has been broken cannot be accepted for return unless they arrived damaged or defective (see Section 6).

2. Non-Returnable Items

The following are not eligible for return or refund once delivered or rendered:

  • Opened or used supplements, consumables, and personal care items
  • Digital products, downloadable content, and online courses once access has been granted
  • Event tickets, workshop bookings, therapy sessions, and consultations once the date has passed or the session has taken place
  • Newros points and any promotional credit
  • Gift cards
  • Items marked as "Final Sale" on the product page

3. How to Request a Return

To request a return, contact us at brainstore.asia@loganmarks.co with your order number and the reason for your return within the eligibility window above. Once approved, we will provide instructions for returning the item, including the return address.

4. Refund Method & Timeline

Approved refunds will be issued to your original payment method via Billplz. Please allow 7–14 business days from the date we receive and inspect the returned item for the refund to reflect in your account, depending on your bank or e-wallet provider's processing time.

5. Exchanges

If you received the wrong item or size, contact us within 7 days of delivery and we will arrange an exchange at no additional cost, subject to stock availability. Where an exchange is not possible, we will process a refund instead.

6. Damaged, Defective or Incorrect Items

If your order arrives damaged, defective, or different from what you ordered, please contact us within 48 hours of delivery with photos of the item and packaging. We will arrange a replacement, exchange, or full refund, including any return shipping cost, at no charge to you.

7. Order Cancellations

You may cancel an order for a full refund at any time before it has been marked as shipped. Once an order has been handed to a courier for delivery, it can no longer be cancelled and must instead follow the return process above.

8. Partner-Fulfilled Item Returns

For items sold by an independent Partner, please still contact us at brainstore.asia@loganmarks.co to start the return — we will coordinate directly with the Partner or their Fulfillment Partner on your behalf so you only need to deal with one point of contact.

9. Late or Missing Refunds

If you haven't received a refund within the timeline above, please first check with your bank or e-wallet provider, as processing times can vary. If it still hasn't appeared, contact us at brainstore.asia@loganmarks.co and we'll look into it for you.
